A business transfer can occur in a number of different scenarios – the whole business may be sold, part of the business may be sold, there may be a merger of businesses, or there may be a change of parties that are providing services relating to a contract. This means that you are afforded with enhanced rights relating to any potential dismissal by your current or new employer and that the rights and duties of your contract of employment are transferred to your new employer. However, your new employer often states that they need to “harmonise” the terms and conditions of its new employees with its current employees and this can leave you uncertain as to what the potential consequences of the business transfer may be. Both your old and your new employer should consult with you regarding the transfer of  your employment but employers are often uncertain as to their obligations in such situations.

We will firstly engage on an informal basis with your employer to try and preempt any potential legal problems – we believe that negotiation is always preferable to litigation. However, if it is not possible to settle your TUPE problem then we will help you through the dispute resolution process. We can help you pursue your litigation through the Employment Tribunal and offer representation at the Employment Tribunal. However, we’ll try and settled your case for you both prior to and during the Employment Tribunal proceedings by engaging with your employer. This may involve the drafting and signing of a compromise agreement.

Chris was very effective and decisive in dealing with my matter. I felt guided, and the pressure to make decisions was taken off my shoulders; he knew what needed to be done and I was happy to follow his advice. The result of the legal dispute was a great success for me. He is also kind and personable. The only thing that I would say it could be improved, is the accuracy of cost estimation at the beginning: not many activites, that could not have been forseen had to take place, but costs went up more than double in the end. Overall very good and trustworthy. I would definately recommend and use Redmans services again.
