The need for compromise agreements arise in a variety of circumstances, most often when an employee’s contract of employment has terminated or is to terminate. However, compromise agreements can also be used to compromise a variety of other claims, including discrimination, contractual disputes, bullying and harassment, and harassment at work (among others). The purpose of a compromise agreement is to compensate an employee for the waving of some or all of their employment law-related rights. This involves the offer of compensation by your employer (or some other incentive) for your agreeing to and signing the compromise agreement.
A settlement agreement is a legally-binding and statutorily-regulated contract between an employer and an employee, under which the employee agrees to waive their right to pursue particular claims against their (former) employer in the Employment Tribunal or civil courts in return for some form of benefit (normally the provision of a reference and the payment of a sum of money).
Our employment law team is based in Richmond, London. Our solicitors are responsive, sympathetic, practical, and expert in their field. Our lawyers provide concise and clear advice on compromise agreements to employees and workers. W e would look to determine what the issues are relating to the compromise agreement and any specific requirements that you have relating to the compromise agreement. We would then negotiate with your employer to secure you the best possible terms.
If the compromise agreement has been subject to appropriate negotiations then it can be an extremely effective means of compensating you for the waiving of your employment law rights against your employer. It avoids the time, cost, stress and uncertainty of Employment Tribunal proceedings.
We treat everyone we represent equally. That means that you’ll receive exactly the same service as any other client when it comes to your compromise agreement – from CEO’s to cleaners, department heads to receptionists. You will receive the best employment law advice and representation at all times and the highest level of client care we can offer. The costs of the compromise agreement are normally covered by your employer but should there be any costs above and beyond those covered by your employer (which there rarely are) we also believe that we offer an extremely competitive fee structure for our employment law services which means that costs are kept low for you, the client.
Compromise agreements were renamed “settlement agreements” in July 2013.
