The law relating to copyright is contained within the Copyright Designs and Patents Act 1998 (“CPDA 1998″).
The CPDA 1998 sets out the law relating to:
- Subsistence (the existence) of copyright
- The rights of the owners of copyright (including rights relating to infringement, length of ownership etc.)
The existence (or subsistence) of copyright is automatic. There is no need to register your work to achieve copyright protection. Copyright seeks to protect the means in which an idea is expressed, not to protect the idea itself, which is normally protected through the law of confidentiality.
Copyright protection normally lasts for the life of the author plus 70 years from the end of the calendar year of their death (s.12 CDPA 1998).
