Experts in Copyright Law

The name, brand, image and creative endeavours of a business and its executives are paramount to the success of that business and your intellectual property deserves the very best protection.

We help clients enforce their intellectual property rights, ensuring through negotiation and litigation that the businesses and executives that we represent are fully aware of their rights and how to protect their brands, image and creative property. This extends to litigation to ensure that your confidential information is kept confidential and outside of the public domain.

Our intellectual property departments works in close conjunction with our litigation department, ensuring that there is a synergy of knowledge relating to the law, procedure and commercial considerations relating to intellectual property.  These complementary skills mean we are also able to provide expert advice on reputation protection issues that often result from intellectual property litigation.

We can provide the protection needed through our expert knowledge of all matters concerning copyright, trademarks, passing off, image rights, trademark logos, domain names, branding and endorsement.

The law relating to copyright is contained within the Copyright Designs and Patents Act 1998 (“CPDA 1998″).

The CPDA 1998 sets out the law relating to:

  1. Subsistence (the existence) of copyright
  2. The rights of the owners of copyright (including rights relating to infringement, length of ownership etc.)

The existence (or subsistence) of copyright is automatic. There is no need to register your work to achieve copyright protection. Copyright seeks to protect the means in which an idea is expressed, not to protect the idea itself, which is normally protected through the law of confidentiality.

Copyright protection normally lasts for the life of the author plus 70 years from the end of the calendar year of their death (s.12 CDPA 1998).

How our specialist copyright lawyers deal with your case

Whether the matter relates to the protection of copyright, the protection of confidential information, the registering and protection of a trademark, the law relating to design rights, or patent law our specialist solicitors can advise you both on your legal position and on how to best address your intellectual property issue.

We aim to achieve the result that fits your particular business or personal needs. We offer advice on the existence of copyright, what rights copyright holders possess, and how you can protect your work against infringement.
